Indenture of Lease & Release bearing the date 18th & 19th April 1808 (48th yr of the reign of King George 3rd) made between David WILBY of Ossett Common side, clothier, one of the sons and a Devisee in ….. Of part of the Tenements and Hereditaments hereinafter mentioned and described in the last Will & Testament of Isaac WILBY late of the same place clothier deceased of the 1st part and Joseph SCOTT of Ossett clothier and Francis WILBY the elder of the same place, clothier………of the other part. Of & concerning all such part and so much as is of the nature of freehold and held by Deed of all that one close of land, arable, meadow or pasture, in Ossett known as the Upper Cross Close or by what other name or names the said close of land now or heretofore has been called, containing by estimation 3 acres, more or less, late the Estate and in the possession of the said Isaac WILBY deceased and by him given and devised to the said David WILBY in whose tenure or occupation the said close of land now is. And also all that piece, parcel of land situate at Giggal Hill marked LOT 9 in Ossett (Inclosure Act) and purchased by David WILBY of the Commissioners, containing by survey 1 acre and 22 perches and adjoining the premises belonging to Mr Benjamin MARSDEN together with the 3 Tenters? thereon standing: And all ways paths passages water courses, ditches styles walls rights etc.. (Ref: 1808 FD 198 262)
On 21st June 1811 land on Giggal Hill containing 3 roods and 11 perches was conveyed to Benjamin BAINES. This was the plot with cottage number 94 on the map – bounded by Horbury Road; Joseph THORNS; and land intended for David WILBY (Ref. 1811 FP 5 5)
This was followed on the 27th & 28th August 1811 by a Memorial of Indenture of Lease & Release. The Lease made between the Rev. Jonathan ALDERSON, Vicar of Hornby, Yorks, Robert LUMB, of Wakefield, Gent. And George William Frederick Duke of Leeds, Lord of the Manor of Wakefield of the 1st Part; John SENIOR Innkeeper, of Wakefield of the other Part.
And the Release being of 4 Parts and made between the said Jonathan ALDERSON, Robert LUMB of the 1st Part; the Duke of Leeds of the 2nd Part; Benjamin MARSDEN of Giggal Hill on Ossett Common, Clothier of the 3rd Part; and the said John SENIOR of the 4th Part.
Of and concerning all that Cottage, Dwellinghouse or Tenement with the Cowhouse and Outbuildings thereto adjoining and all that Garden or parcel of enclosed ground and a parcel of newly allotted land adjoining thereto and being on Ossett Common at a place there called Giggal Hill containing altogether by survey 3 roods and 17 perches (approx.) bounded by a Cottage, land and premises of the said Duke of Leeds, in the occupation of James DEWS, by an allotment sold, or contracted to be sold, by the Commissioners for the Ossett Inclosure Act, to David WILBY, by premises of the said Duke of Leeds in the occupation of Samuel AUDSLEY and by allotments of and now in the occupation of the said Benjamin MARSDEN, his assigns or undertenants together with all outbuildings, appurtenances etc….and particularly a Right of Way of the breadth of 4 yards at all times thereafter for all purposes whatsoever for the said Benjamin MARSDEN, his heirs and assigns and his and their tenants and all other persons going to and from the premises thereby released with or without Horses, Carts or Carriages into and over and through an Allotment of the said Duke (part whereof is sold to Benjamin BAINES) to and from the road called Horbury Road (later Manor Rd.) in a line along the ‘front’ of Mr Joseph THORNS’ land and in a line at the ‘back’ of the said cottage in the occupation of the said James DEWS into and from the hereditaments and premises thereby released, which Right of Way is to be continued in a straight line forwards of the same breadth into over and through the premises thereby released along the ‘front’ of the said allotment, released aforesaid to the said David WILBY into the foldstead belonging to the said premises of the said Duke in the occupation of Samuel AUDSLEY, and is by the said Indenture of Release reserved to the said Jonathan ALDERSON and Robert LUMB etc……(Ref. 1811 FQ 75 93)

1813 THE WILL OF BENJAMIN MARSDEN the elder
All my real & personal estate and interest in the Dyehouse near Healey Mill left to my wife Sarah until her decease or remarriage; then equal half parts of the Plot called the Long Close (2 Acres, 2 Roods & 8 Perches) in Ossett (possibly on the Green near Healey Rd) to my eldest son John and next son Benjamin the younger, formerly occupied by myself. The said close to be divided by a fence down the middle and the north half to John and the south to Benjamin. John should have liberty etc. of a foot & carriageway through the south half to his north half with a front of 25 yds adjoining the Horbury Road (Horbury Rd., or the ‘Royal Road to Wakefield’, came down the Green before turning up the present Giggal Hill) in a direct line to the north half up the said middle fence which is to divide the said close. Also after Sarah’s death or remarriage each of these 2 sons to receive 1 stand in the cloth hall (he owned 2). But I charge my 2 sons John & Benjamin to make £80 (£40 each) to bequeath to my youngest son Joseph, when he becomes 21. Also, after Sarah’s death/remarriage etc. the messuage/dwellinghouse & parlour etc., where I now live & chambers over the same with milk house garden belonging being situate on Ossett Common & I order that the road now leading to the dwelling shall be divided and opened into the Occupation Rd., on the north side of the same dwelling and that a partition wall shall be built & maintained by the said daughter Mary to divide & separate the dwelling from the adjoining shop barn, mistal or cowhouse which same with their appurtenances and also that allotment of land adjoining thereto its appurtenances which I purchased from the Lord of the Manor of Wakefield I give & bequeath unto my daughter Hannah. But I charge & make chargeable the property so divided to my said daughters Mary & Hannah with the payment of £70 (£35 each) which I bequeath/devise etc to my youngest daughter Elizabeth at the age of 21. (Benjamin’s Will was signed 2nd Jan 1812).
Benjamin was buried on 18th February 1813 at Horbury St. Peter’s, aged 47
Sarah was buried on 5th May 1814 also at Horbury St Peter’s, aged 45

1816
Memorial of certain Indentures of Lease & Release…between John DAWSON of West Bretton, Parish of Sandal Magna the 1st part and Mary MARSDEN ( Daughter of Benjamin & Sarah, older sister of John & Hannah) spinster of Ossett Common, Ossett of the other part. Of and concerning all that allotment, close, piece, parcel of land, situate near to Giggal Hill on Ossett Common in the township of Ossett aforesaid being 2 roods, more or less, being lately now allotted land under the Ossett Inclosure Act 1813 to the Duke of Leeds and conveyed amongst other property to the said John DAWSON which said allotment, close, parcel of land is bounded on the east by an allotment now belonging to Hannah MARSDEN, on the west by an allotment or garden now belonging to or in the occupation of Martha GIGALL, north by land & belonging to the said Mary MARSDEN and south by an allotment and premises now or lately belonging to Messrs CONINGTON, LOFT and Widow MOSS together with all singular rights, members & appurtenances to the said premises belonging and appertaining which said Indenture of lease and release as to the execution thereof by the said John DAWSON and to the said Indenture of release by the said Mary MARSDEN was witnessed by William DAWSON of Lofthouse, and Thomas LEE of Wakefield. (Ref: 1816 GL 215 217)
(The Deed 1816 FQ 75 93 showed Benjamin Marsden the elder (born 10th Mar 1765) acquiring the Plot containing Cottage No 98 on the map. In 1812 the next Plot containing cottage 97 was conveyed to John DAWSON, as part of a larger transaction (Ref. FW 454 461) However, Benjamin was buried 18th February 1813, in Horbury Cemetery, and in his Will, signed Jan 2nd 1812, devised the Cottage No 98 and land to be divided between his two oldest daughters Mary and Hannah MARSDEN. Also in 1813 the plot containing cottage 99 was conveyed to Samuel AUDSLEY (bounded by Benj. Marsden, David & John WILBY and another plot already in his possession. (Ref:1816 FZ 136 168).

Mary MARSDEN was buried on 21st March 1822 and her share in Plot 98 then passed to Hannah.
In 1841 Hannah MARSDEN conveyed a piece of land on Giggal Hill, measuring 850 sq yds, which was part of the land purchased by Benjamin MARSDEN from the Lord of the Manor of Wakefield and devised to Hannah in his Will; bounded by property belonging to Nathan MITCHELL, in his own occupation, by property of Mr LEE and property of Henry Castile SCOTT and others (Ref: 1841 NX 479 419) (It is not clear who it was conveyed to!)
Abram PICKARD, Ossett Common, Cloth Manufacturer and Susannah (nee SCOTT) his wife 1st Part; Samuel PICKARD, Clothier, 2nd Part John NETTLETON, Gent 3rd part: And also all that other piece, parcel of land situate at Giggal Hill marked LOT 9 and containing by estimation 1 acre 22 perches in the occupation of Abram PICKARD, and also of and including all houses, outhouses etc., upon the land and herewith all pews, seats and sittings in the Chapel of Ossett, etc.(Ref: 1841 OF 40 30)

Benjamin MARSDEN Junr.(Born 1800) died in 1844 aged 43, and was buried at Horbury St. Peter’s on 7th April 1844 (Jane his wife died prior to him on 5th April 1840, aged 28), leaving a daughter Sarah Ann Marsden (born 1833).
John MARSDEN Died 11th December 1849 and was buried on 16th December at Horbury.
WILL OF JOHN MARSDEN of Storrs Hill, Ossett, skinner. 30th day of January 1850 Joseph MARSDEN of Storrs Hill Ossett, Fellmonger, the brother of the Testator John MARSDEN was sworn in as Executor.
“I devise all real estates vested in me as mortgagee or trustee with my Brother Joseph MARSDEN and my sister Hannah MARSDEN upon such trusts and subject to such equities as shall at my decease be subsisting concerning the same respectively. I give and devise the Dwellinghouse, Parlour, Shop and Croft of land situate on Giggle Hill in Ossett aforesaid now or late in the several occupations of myself, my brother Joseph MARSDEN and Philip BRIGGS with rights members and appurtenances unto my sister Hannah MARSDEN for and during the term of her natural life and upon her decease I give and devise the same Dwellinghouse, Parlour Shop & Croft of land unto my niece Sarah Ann MARSDEN, her heirs and assigns forever. I give and devise my two fifths shares in Breary Mapplewell Close in Ossett aforesaid unto my sister Hannah MARSDEN for and during the term of her natural life and after her decease I give and devise the same 2/5ths shares in Breary Mapplewell Close unto my nephews John Marsden LAYCOCK and Alfred LAYCOCK: To hold to them their heirs and assigns forever as Tenants in Common and not as Joint Tenants. I give and bequeath unto my niece Sarah Ann LAYCOCK the legacy of £50 to be paid to her when she attains the age of 22 yrs by my Executor and Executrix hereinafter named. I give devise & bequeath all the residue and remainder of my real and personal estate not hereinbefore disposed of (but subject to the payment of my just debts funeral and testamentary expenses and the expenses of proving and registering this, my Will), unto my said Brother Joseph MARSDEN, his heirs executors administrators and assigns. I appoint my said Brother Joseph MARSDEN and my sister Hannah MARSDEN Executor and Executrix of this my Will and I hereby revoke all former and other Wills by me heretofore made.” Witnessed & signed 12th December 1848 Sworn Under £200 1850 Prerogative 5th March 1850
1850 Nov 29th
William LEE of Horbury, yeoman 1st Part Jane Ann Craven LEE, spinster and Adelaide Craven LEE, spinster both of Horbury, (the only surviving children of William LEE) 2nd part and Joseph MARSDEN of Storrs Hill, Ossett 3rd Part. All & concerning all that is freehold or mixed tenure undistinguished held by Deeds etc. All that close of land situate on Ossett Common – 1 acre 25 perches approx East by land allocated to the Duke of Leeds West by Horbury Bridle Rd., North by land awarded to James Conington, John Loft & Elizabeth Codd South by land awarded to Joshua Haigh the younger and Thomas Mitchell And which said allotment or parcel of land was awarded to John CRAVEN by the Commissioners of the Inclosure award 1rood & 11perches northward side freehold; 1 rood 14 perches middle copyhold compounded for the Manor of Wakefield and the residue thereof being 2 roods on the southward side of the same freehold & copyhold compounded together with appurtenances to the same belonging. Joseph MARSDEN, Storrs Hill, Skinner & Ellen his wife 1st Part; John HARROP of Ossett Common, Woollen Cloth Manufacturer 2nd Part; Nathan MITCHELL of Ossett Common, Farmer, 3rd Part All that parcel of land etc……… 1 Acre 25 perches; east by land awarded to the Duke of Leeds; west by Horbury Bridle Road; north by James CONINGTON, Joseph LOFT & Elizabeth CODD; south by Joshua HAIGH the younger and Thomas MITCHELL, awarded to the late John CRAVEN, Ossett Inclosure Award – (same details as LEE to MARSDEN re. land details and all other tithes belonging to Joseph MARSDEN and premises & appurtenances (Ref: SR 234 251)
(The Deed shows Nathan MITCHELL, Farmer, whose land was the next plot to Joseph’s, has some involvement, which probably meant that he was farming this land as well as his own. There was mention of a Mistal (a building where cows are milked) which ‘suggests’ that Nathan MITCHELL had kept cows on the land and Joseph MARSDEN, a skinner or fellmonger, used the skins. Joseph MARSDEN, who never actually lived on the Highfield Plot, died in 1860, aged 50 yrs. Nathan MITCHELL may have carried on using the land for cattle after it was sold to John HARROP (There is no evidence of Nathan MITCHELL ever owning this PLOT)

Hannah MARSDEN (sister of Joseph) of Storrs Hill, Spinster 1st Part; Joseph MARSDEN, Skinner 2nd part & William HOLT, Gentleman (on1861 Census he is listed as Attorney & Solicitor) of Horbury 3rd Part. Cottage, Dwellinghouse or Tenement, Cowhouse, outbuildings, formerly occupied by Benjamin MARSDEN (elder brother of Hannah, John & Joseph) dec’d but now by David CLAFTON, & all that garden or parcel of enclosed ground, and a parcel of newly allotted land adjoining on Ossett Common called Giggal Hill 3 roods & 17 perches, bounded by cottage & land formerly awarded to the Duke of Leeds, then James DEWS, by allotment of David WILBY (Inclosure Act) & by premises formerly of the said Duke of Leeds & then occupied by Samuel AUDSLEY & by allotments now belonging to John HARROP & David HEY and also all that dwelling or tenement recently erected upon part of the land, by now Memorializing Indenture conveyed. (I have been unable to find any evidence of David Hey owning land/property, perhaps he was renting it?
This is the Plot containing Cottage No 98 on the 1807-13 Inclosure Award
Joseph died 17th Jul 1860 Probate granted in Wakefield to Ellen Marsden 30th Jan 1861 and the Will was proved on 18th February 1863 in Wakefield
THE WILL OF JOSEPH MARSDEN signed 21s June 1860
Hannah MARSDEN Died and was buried on 20th August 1862, aged 66, at South Ossett Church.
In accordance with the Wills of her father Benjamin and brother John part of Hannah’s property now passed to her niece Sarah Ann MITCHELL (Sarah Ann MARSDEN married George MITCHELL at South Ossett Church on 10th February 1859)

1864 March 10th Memorial of an Indenture dated 9/3/1864 between William GARTSIDE of Ossett, Dyer of the 1st part; Nathan MITCHELL of Ossett, Farmer of the 2nd Part and Samuel PICKARD of Ossett, Clothier of the 3rd part. ………..Firstly all that messuage or dwellinghouse with the outbuildings foldstead garden and conveniences thereto adjoining and therewith occupied by the said Nathan MITCHELL and also all that allotment or parcel of land adjoining thereto situate and being on Ossett Common, Ossett aforesaid at or near a place called Giggal Hill and containing altogether with the scite? of the said messuage or dwellinghouse & outbuildings 1 acre and 8 ps approx. bounded by land late of the Duke of Leeds sold to Benjamin MARSDEN by land sold by the Commissioner executing the Ossett Inclosure Act to David & Isaac WILBY and Samuel AUDSLEY and by allotment of Thomas MITCHELL and John CRAVEN also all that other parcel of land lying adjoining to the last mentioned allotment containing by survey 1 acre & 18 perches, purchased by the said Samuel AUDSLEY of the Commissioner under the Inclosure Act which were formerly in the occupation of William ARMITAGE, then John ELLIS but now by Nathan MITCHELL. Secondly all that parcel of land on Ossett Common containing approx. 2 roods & 12 perches being a moiety of a close of land purchased by Charles SCOTT (Inclosure Act Lot 11) bounded on or towards the North by the other moiety or close purchased by George PICKARD of the representative of George SCOTT on or towards the East by an occupation road leading from Ossett to Horbury on or towards the South by part of the premises firstly described on or toward the West by property belonging to the Representative of the late Joseph MITCHELL dec’d, now Nathan MITCHELL. Thirdly all that land or ground situate on Ossett Common containing 850 sq yds – part of a piece of land purchased by Benjamin MARSDEN dec’d of the Lord of the Manor of Wakefield & devised by his Will to Hannah MARSDEN which is bounded partly by the garden & other premises forming part of the premises firstly before described by the property late belonging to Mr. LEE, now to John HARROP, partly belonging to Henry Castile SCOTT and partly by the other portion of the said allotment so devised to Hannah MARSDEN & also all the erections & buildings now erected & built upon this land & said hereditaments & premises described once in the possession of Nathan MITCHELL together with appurtenances. Memorial to be registered of an Indenture. Between: George MITCHELL of Storrs Hill, Ossett, Farmer and Manufacturer & Sarah Ann his wife (formerly Marsden (daughter of Benjamin dec’d (born 1800)) the 1st Part and Ellen MARSDEN, of Giggal Hill, (widow of Joseph), the other part Of and concerning all that plot, piece, parcel of land situated at Giggal hill aforesaid (with the shop & all other erections thereon, containing by admeasurements 195 superficial sq yds more or less and bounded South & North ends & East side by property belonging to the said Ellen MARSDEN and West side by other property of the said George MITCHELL & Sarah Ann his wife, from which it is separated by a line drawn in continuation of and for the most part parallel with the fence belonging to the said George MITCHELL & Sarah Ann MITCHELL, on the South end of the said plot of land & is more particularly delineated & described in the plan thereof drawn on the back of the now memorializing Indenture & thereon coloured Pink; together with the appurtenances same nevertheless & excepted out of the now memorializing Indenture, the Well delineated in the said plan and all rights of way over or along the present road into the said plot of land, shop, hereditaments, through & over the adjoining land belonging to the said George & Sarah Ann MITCHELL from the Occupation Rd.,(School Lane, then Church Lane & eventually Vicar Lane) at the North end or side thereof and the said Indenture as to the execution thereof by the said George Mitchell ..witnessed etc…. George MITCHELL of Ossett, Manufacturer & Sarah Ann, his wife (who before she was married was called Sarah Ann MARSDEN) 1st Part. John HEY & John HEMINGWAY, Ossett both Manufacturers 2nd Part. Of & concerning all that freehold allotment, close, piece of land etc. situate near Giggle Hill on Ossett Common containing 2rs approx. Being land formerly allotted to the Duke of Leeds and conveyed (amongst other property) to John DAWSON and which said allotment is bounded towards the North partly by South Ossett Parsonage grounds & partly by property formerly of George MITCHELL & Sarah Ann his wife, on or towards the South ** by other property of John HEY & John HEMINGWAY**, towards the East by property belonging to Mrs Ellen MARSDEN & on or towards the west by South Ossett Burial Ground. Together with appurtenances & more partly a full, free & uninterrupted right of road width of 10ft for all purposes etc. & on all occasions for John HEY & John HEMINGWAY, their heirs & assigns etc., to pass & repass into & from & out of the said allotment, croft etc., commencing at or near the northern end thereof 6 yds from South Ossett Parsonage Grounds, over the remaining property of George & Sarah Ann MITCHELL and into and communicating with a certain road or way which leads into the Public Rd., or way called Giggle Hill Rd., with reserving rights re. Mines etc., and by certain Indentures of Lease & Release dated 1st & 2nd Nov. 1812, between Rev. Jonathan Alderson, Clerk, and Vicar of Hornby York, 1st Part and most Noble Geo. A Memorial to be registered of an Indenture bearing the date 29th Nov 1870 Between: Ellen MARSDEN, of Giggal Hill, widow of the 1st Part. And G. H. HOLT of Horbury, Solicitor, the other Part. Of and concerning all that Plot, piece, parcel of land situate at Giggal Hill aforesaid (with the shop & all other erections thereon) containing by admeasurement 195 superficial sq yds more or less bounded South & North ends & E side by property belonging to the said Ellen MARSDEN and West side by other property of the said George MITCHELL & Sarah Ann his wife, from which it is separated by a line drawn in continuation of & for the most part parallel with the fence belonging to the said George MITCHELL & Sarah Ann MITCHELL, on the South end of the said plot of land & is more particularly delineated & described in the plan thereof drawn on the back of the now memorializing Indenture, bearing the date 13th Nov 1865 between George & Sarah Ann MITCHELL & the said Ellen MARSDEN, & thereon coloured Pink; together with the appurtenances. Which said Indenture as to the Execution thereof by the said Ellen MARSDEN & G.H HOLT is witnessed etc….). (This is the same as 1865 YQ 495 539 – most likely something to do with a mortgage)
The 1871 Census (In Chapter one) shows Church Lane (as it became known after the Church was built in 1851) with John HEY and John HEMINGWAY living close to Ellen MARSDEN. This denotes that the dwellings which became known as CLARENDON VILLAS were built between 1866 and 1871.

WILL OF DAVID HEY Died 10th Sept. 1875 in Wakefield. Will signed 1866. Will proved 26th Jan 1876 at Wakefield. Executors/Trustees, John HEY (son), Joseph ELLIS (dec’d beforehand) and Eli ELLIS. (Unfortunately David’s Will did not mention his land.)

John HEY & John HEMINGWAY, Ossett, woollen Manufacturers, lately carrying on business at Ossett under the style of Hey & Hemingway, Woollen Cloth Manufacturers. 1st Part ; Philip Henry ELY of Ossett, Rag & Mungo Merchant. 2nd Part: WAKEFIELD & BARNSLEY UNION BANK 3rd Part Of Of & concerning all that freehold allotment, close, piece of land etc. situate near Giggal Hill on Ossett Common containing 2rs approx. being land formerly allotted to the Duke of Leeds and conveyed (amongst other property) to John DAWSON and also all those 2 dwellings with outbuildings then erected thereon & then in the occupation of the said John HEY & John HEMINGWAY which said allotment is bounded towards the North partly by South Ossett Parsonage grounds & partly by property formerly of George MITCHELL & Sarah Ann his wife, towards the East by property belonging to Mrs Ellen MARSDEN & on or towards the west by South Ossett Burial Ground. And all other real estate whatsoever & of which John HEY & John HEMINGWAY of the said Philip ELY as such Trustee or any other person in trust for them was or were seized, possessed or entitled at the date thereof for any estate in possession, reversion or remainder together with appurtenances (and particularly a full free uninterrupted right of road width 10ft for all purposes & occasions for the said Banking Co, their successors & assigns etc. (Ref: 1879 830 519 599)

ALL THAT plot of land situate between Vicar Lane and Horbury Rd., Ossett and also all that Dwellinghouse with the outbuildings thereto belonging erected on the said plot of land or on some part or parts thereof and known as Number 4 Clarendon Villas Ossett.
